Unlike child support, there is no fixed formula to calculate California spousal support (also called maintenance or alimony).

California’s spousal support laws are largely subjective. As a result, spousal support often becomes one of the more contested issues of divorce. The two parties may dispute whether spousal support is awarded, the amount of spousal support, how long it continues, when it can be terminated, and when it can be modified.

The factors used in determining spousal support include:

• The standard of living the spouse has enjoyed during the marriage.
• The amount of education each parent has.
• The earning ability of each parent
• The amount of time during the marriage one party spent caring for the child as opposed to developing his or her career.
• The age and health of the parties.
• The length of the marriage
